These Terms of Use ("Terms") govern your access to and use of the Rock. Paper. Science! LLC ("RPSCI," "we," "our," or "us") websites, rockpaperscience.com and rpsci.com, their associated subdomains (collectively, the "Platform"), and all related services we provide (the "Services").

By accessing the Platform or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Platform or use our Services.

1. Our Services

RPSCI provides technical consulting, strategic audits, and creative services. Our Platform includes general information about our work, a means of contact, and may be used to deliver private audit reports and other materials via unique URLs.

2. Intellectual Property Rights

The Platform and its original content, features, and functionality—including but not limited to all information, text, graphics, logos, images, as well as our audit frameworks and methodologies—are and will remain the exclusive property of Rock. Paper. Science! LLC and its licensors. Our intellectual property is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and content may not be used in connection with any product or service without the prior written consent of RPSCI.

3. Acceptable Use

You agree not to use the Platform or Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform. You agree not to:

Our Services may include the creation and delivery of audits, reports, recommendations, and other materials ("Deliverables"). All Deliverables we provide are:

  • Based on publicly available data and/or data you voluntarily share.
  • Intended for informational purposes only.
  • Provided "as-is," without guarantees of specific business outcomes.

Deliverables are for your internal use only and may not be republished, redistributed, or sold without our express written permission. Access to Deliverables provided via a private URL may be archived or removed after a period of 90 days from delivery.

By receiving our Deliverables, you acknowledge that strategic recommendations involve inherent uncertainties and that results may vary based on implementation, market conditions, and other factors beyond our control.

IN NO EVENT SHALL ROCK. PAPER. SCIENCE! LLC, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM, SERVICES, OR DELIVERABLES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF RPSCI EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM.

IF NO PAYMENT WAS MADE FOR THE SPECIFIC SERVICE IN QUESTION, YOU AGREE THAT THE TOTAL AGGREGATE LIABILITY OF RPSCI SHALL BE ZERO.

6. Third-Party Links

Our Platform may contain links to third-party websites or services that are not owned or controlled by RPSCI. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that RPSCI shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

7. Termination

We may terminate or suspend your access to our Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal or state courts of competent jurisdiction located in Osceola County, Florida.

You agree to first attempt to resolve any disputes through good faith negotiations for at least 30 days before pursuing formal legal action.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post the new terms on this page and update the "Last updated" date. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
